Regional Office of Ljubljana, issued ex officiale on the basis of Sections 77, 85 and 92 of the Act on Veterinary Compliance Criteria (Official Gazette of the Republic of Slovenia, Nos. 93/05, 90/12 - ZdZPVHVVR, 23/13 - ZZZiv-C, 40/14 - ZIN-B and 22/18, hereinafter referred to as ZVMS) and in connection with the third paragraph of the first paragraph of Section 43 of the Animal Protection Act (Official Gazette of the Republic of Slovenia, Nos. 38/13 - official revised text, 21/18 - ZNORg, 92/20 and 159/21, hereinafter referred to as ZZZiv) in the administrative inspection case for the protection of domestic animals, to the owner of a cat, a foreigner from Lithuania, Konstantin Korenevskij, Shelter House Ljubljana - Vic, K. v. Gorice 15, 1000 inheritance of Ljubljana.
RESOLUTION:
1. Black cat, 2 years old, named Case, is in the permanent ownership of owner Konstantin Korenevsky.
2. The measure specified in paragraph 1 of the operative part of this decision shall enter into force on the day of delivery of this decision to the Ljubljana Zoo, animal shelter, Gmajnice 30, 1000 Ljubljana, which may immediately hand over the 2-year-old fawn cat named Katse to a new guardian.
3. A separate decision will be made regarding the cost of the procedure.
4. An appeal against this decision shall not suspend its execution.
Explanation:
On 7 July 2023, the Veterinary Service of the Asylum Home Ljubljana, located at the Asylum Home Ljubljana - Vic. S. at Gorice 15, 1000 Ljubljana, in connection with the discovery of a cat locked in a car belonging to an applicant for international protection from Lithuania, discovered that the locked cat was in the parking lot next to the Asylum Home Ljubljana - Vic. in a Mercedes car, registration number LT L60927. The car was locked and parked in the sun (the temperature outside was 27 C, and it was getting hotter inside!). The front windows of the car were open by about 3 cm and was open the sunroof. Inside the car, on the floor near the passenger seat, there was food and water in containers. The toilet was in the baggage area, but the car smelled strongly of urine. A social worker from the Ljubljana-Vik shelter, who was present, brought the cat's guardian, a foreigner from Lithuania, Konstantin Korenevsky (hereinafter referred to as the responsible person), who opened the car and handed over the frightened black cat to the caretaker of Asylum homa with securety and caretaker the Ljubljana Zoo, and caretaker the Ljubljana Shelter for Abandoned Animals. Since the caretaker of the Asylum Home with Security and the caretaker of the Ljubljana Zoo, and the caretaker of the Ljubljana Shelter for Abandoned Animals did not speak English, and communication in English was complex for them for the purposes of this procedure, the official veterinarian, in order not to violate the provisions on the use of language, ex officiale for the purposes of translation from Slovenian into Russian by telephone via loudspeaker, as provided for in paragraph 7 of Article 62 of the General Administrative Procedure Act (Official Gazette of the Republic of Slovenia, No. 24/06 - official revised text, 105/06 - ZUS-1, 126/07, 65/08, 8/10 and 82/13 and 175/20 - ZIUOPDVE, hereinafter referred to as ZUP), appointed the translator Olga Marčič.
A decision was made on this issue for the record. The decision was communicated to the parties orally in accordance with paragraph 3 ZUP and is not subject to appeal in accordance with section 258 ZUP.
The person of the cat said that he the cat living in the car for about 5 days where he took care of her daily (there was plenty of water in the car at all times, he fed her, walked her during the day). They arrived in Slovenia on July 5, 2023.
The cat had no ID, he was not microchipped, his name was Case, he was a black boy and he was two years old (he had had him since he was a kitten). The defendant said that the cat was registered at a veterinary clinic in the city of Plunge, Lithuania, and gave the phone number of the senior veterinarian and the owner of the clinic, and also said that the cat had been vaccinated against rabies, but the defendant had no evidence of this. Therefore in this investigation the identity of the cat was not proven during.
As a result, it was found that the transportation of cats was non-commercial and was carried out economically from Lithuania (an EU member state) without an identity document and a valid rabies vaccination, and that the owner did not provide acceptable conditions of detention, since the cat be used torture, the court ordered the removal of the cat and its placement in the Ljubljana Zoo as food for other animals - The Shelter for abandoned animals Ljubljana, Gmajnice 30, 1000 Ljubljana.
Paragraph 15 of the first paragraph of Article 43 of the Animal Protection Law, together with paragraph 32 of Article 5 of the said Law, establishes that the shelter is obliged to ensure the capture, transportation, placement and care of the confiscated animal.
All measures were explained to the taxpayer through an interpreter in a form understandable to him on russian language. In the recording, he said in English that he would try to find suitable living conditions for the cat or an apartment for himself after the quarantine ends. Before this moment, he asked to be given the opportunity to will pay the shelter for keeping the cat. He was the understand of told in Russian that this was impossible, that the costs would be collected after the decision was made, and if he did not provide him with adequate living conditions within 30 days, the cat would be permanently confiscated and transferred to a new guardian. The defendant had no comments on this matter.
On 7/8/2023, the official veterinarian determines that the responsible party does not have appropriate living conditions for a black cat, 2 years old, named Case, since the responsible party is permanently staying in a Asylum Home in Ljubljana, Cesta v Gorice 15, Ljubljana, where animals are not allowed, as evidenced by an email sent on 6/7/2023 to Vesna Kerznar Debelec, a social worker from the Asylum Home (U06172-1063/2023/2). Mgr Tita Marija Hucek, a professional employee from the nursing home, informed the official veterinarian in an email dated 3.8.2023 that she had spoken with Korenevsky Konstantin, an applicant for international protection. He was interested in what would happen to the cat if we appropriated it, he expected to receive official status and wanted to collect money outside the Republic of Slovenia in the future to cover the costs of keeping the cat on commercial terms in the asylum for animal.
He also proposed to work off the specified amount as a volunteer at the shelter and take care of cats and other animals at the shelter for animals. The official veterinarian Tata Marija Guček, MSc, a specialist at the Azolni dom shelter, responded in an email on 4 March 2023 that he should contact the LJ Zoo administration, since the Ljubljana Shelter for Abandoned Animals is their internal organizational unit.
In accordance with the first paragraph of Article 31 of the Animal Law, all expenses related to an abandoned animal are covered by the animal's previous guardian. After 30 days from the moment the animal is placed in the shelter, further expenses for daily care shall be borne by the owner of the shelter in which the animal is placed, which corresponds to the sixth paragraph of the above-mentioned article of the said law.
An abandoned animal, according to paragraph 32 of Article 5 ZZZiv, is a found, given up or confiscated pet. Keeping a two year old black cat named Case is an unnecessary expense for both the caregiver and the shelter, so in the long run, the reserve is to take the cat away from the caregiver and hand him over to a new caregiver or euthanize the cat, which then ultimately becomes the property of the shelter as food for zoo, there was determined by the shelter's veterinarian after the necessary examination.
The third paragraph of the first point of Article 43 p on the protection of animals establishes that an inspector who, during an inspection, discovers violations of the provisions of the above-mentioned law has the right and is obliged to temporarily or permanently confiscate the animal. The basis for this decision is set out in the fourth paragraph of Article 85 ZVMS in conjunction with Article 43 ZZZiv.
An appeal against this decision shall not suspend the execution of the measures prescribed in accordance with the second paragraph of Article 92 of the ZVMS.
The costs of the procedure will be determined by a special decision in accordance with the fourth paragraph of Section 118 of the General Administrative Procedure Act (Official Gazette of the Republic of Slovenia, No. 24/06 - official explanatory text, 105/06 - ZUS-1, 126/07, 65/08, 8/10, 82/13, 175/20 - ZIUOPDVE and 3/22 - ZDeb, hereinafter referred to as ZUP).
According to Article 5, paragraph 32 of the ZZZiv Law, abandoned animals are found, surrendered or taken away domestic animals. Article 31 of the aforementioned Law provides that all expenses related to an abandoned animal during the first 30 days of placement in a shelter are paid by the previous guardian of the animal.
The decision is issued ex official and, in accordance with Article 22 of the Administrative Fees Act (Official Gazette of the Republic of Slovenia, No. 106/10 - official revised text, 14/15 - ZUUJFO, 84/15 - ZzelP-J, 32/16 and 30/18 - ZKZas, 189/20 ZFRO, hereinafter referred to as ZUT), is not subject to a fee.
Remedy:
An appeal against this decision may be lodged within 8 days from the date of service at the Ministry of Agriculture, Forestry and Food, Dunajska 22, 1000 Ljubljana. The appeal is submitted in writing or orally, entered into the minutes, or by registered mail or sent by e-mail with a secure electronic signature to the body that issued the decision in the first instance (UVHVVR, OU Ljubljana, Dunajska cesta 22, 1000 Ljubljana). In accordance with the provisions of tariff point 2 of the Waterway Charge Act ZUT - UPB5, the appeal must be accompanied by a receipt for payment of the administrative fee of 18.10 euros. The administrative fee in the specified amount must be transferred to the address: Administration of the Republic of Slovenia for Food Safety, Veterinary and Plant Protection, Dunajska 22, 1000 Ljubljana, TRR 01100-1000315637, reference 11 23370-7111002-931001, indicating the purpose of payment - payment of the administrative fee.
